1. SCOPE OF SERVICES

BISJHINTUS BLOG PORTAL (https://blog.bisjhintus.com) shall provide access to all the blog courses listed on the blog website (the ‘courses’). As a condition of purchasing and participating in any blogging course provided by us, you agree to be bound by all the policies and procedures set out in this agreement, including those incorporated by reference (if any). If you do not agree to be bound by these terms and conditions please cease your participation in the course immediately.

2. ACCESS TO BISJHINTUS BLOG 

In order to access the blog website, you must register for an account via the Bisjhintus blog website. If you already have an account on our website, you can log into your account using your username and password.

3.    ADVERTISING PRICES 

BISJHINTUS BLOG PLATFORM reserves the right to adjust prices at our sole discretion, at any time and without notice to you, provided that we will provide you with at least 10 days in advance notice of any price changes with your specific plan rate. Your use of our blog services after such notice has been delivered to constitute your acceptance of such price changes unless you cancel your subscription to our advertising services through BISJHINTUS in accordance with these Terms. All prices shown for Advertising services through BISJHINTUS are in Indian Rupee (INR). Any applicable taxes and other fees or charges are not included and are additional to any prices shown on our blog website.

4.  PAYMENT FOR ADVERTISING THROUGH BISJHINTUS

By advertising through M/s BISJHINTUS PRIVATE LIMITED blog website, you agree to pay the company the fees indicated in the Payment processing related to such advertising performed by either the company directly or by the company’s affiliates on the behalf of the company depending on the type of the payment method used. You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms for such advertisement in effect at the time a fee or charge is due and payable. You also agree to pay all applicable taxes. You must provide the Company with valid payment information in connection with your advertisement. By providing the Company with your payment information, you agree that:

(i) the Company is authorized to immediately invoice your Account for all fees and charges due and payable to the Company hereunder, (1) the Company is authorized to share any payment information and instructions required to complete the payment transactions with its third-party payment service providers (e.g., credit card transaction processing, merchant settlement, and related services), and;

(ii) no additional notice or consent is required for the foregoing authorizations. You agree to immediately notify the Company of any change in your payment information; The Company reserves the right at any time to change its prices and billing methods; If payment cannot be charged to your payment card or your payment is returned for any reason, the Company reserves the right to either suspend or terminate posting such advertisement; When you provide payment information to the Company or to one of its payment processors, you represent to the Company that you are the authorized user of the card, PIN, key, or account associated with that payment, and you authorize the Company to charge your credit card or to process your payment with the chosen third-party payment processor for any Membership, Product or other fees incurred by you; The Company may require you to provide your address or other information to meet its obligations under applicable tax law.

5.  CHANGES IN TERMS AND CONDITIONS

M/s BISJHINTUS PRIVATE LIMITED reserves the right to modify these Terms at any time as and when it is necessary. These changes to the Terms and Conditions Agreement will be for valid reasons, such as improving our existing blog services or features by adding new functions to our BLOG SERVICES. If we make any changes to these Terms, we will post the revised Terms on the BISJHINTUS BLOG PLATFORM and update the “Last Updated” date at the top of these Terms. If you disagree with the revised Terms of M/s BISJHINTUS PRIVATE LIMITED you may terminate this Agreement with immediate effect. If you do not terminate your agreement and continue to access BISJHINTUS BLOG PLATFORM, it will constitute acceptance to the revised terms and conditions.

6.   LIMITATION OF LIABILITY 

M/s BISJHINTUS PRIVATE LIMITED is not responsible for any suspension or interruption of the BLOG accessed through our BLOG Website. BISJHINTUS BLOG PORTAL does not guarantee that the system is stable and uninterrupted. M/s BISJHINTUS PRIVATE LIMITED will only provide you with the service based on its current function and status and reserves the right to modify all or part of each service function at any time. Although the Company will use reasonable efforts to keep the BLOG Website and the information on the website and Courses reasonably accurate, the Company makes no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the Website for any purpose. all such information, software, products, services, and related graphics are provided "as is". M/s BISJHINTUS PRIVATE LIMITED disclaims all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular: purpose, title, and non-infringement. While BISJHINTUS BLOG PORTAL uses our best endeavors to ensure all your data is secure and complete in the servers, we will not be liable for loss of profits or of contracts, loss of data, damage to your computer hardware or software, loss of business, loss of goodwill or reputation, loss of revenue, loss of anticipated savings, loss of business opportunity, loss of use, and/or consequential loss arising out of or in connection with this website or the information or data contained in it.

7.   GOVERNING LAW

With respect to any dispute regarding the BISJHINTU’S BLOG PORTAL, all rights and actions contemplated by these Terms and Conditions shall be governed by the laws of Mangalore without giving effect to any principles of conflict of laws, as if these Terms and Conditions were a contract wholly performed within Mangalore.

You may not allow anyone else to access online blog services via your login details. M/s BISJHINTUS PRIVATE LIMITED reserves the right to remove any delegate from the use of blog services whose behavior is deemed inappropriate byM/s BISJHINTUS PRIVATE LIMITED or its instructors. In these circumstances, M/s BISJHINTUS PRIVATE LIMITED will neither refund any fees nor reimburse any other costs.

9.   COMMENTS AND WRITING

9.1 BISJHINTUS BLOG PORTAL offers an opportunity for users to post and exchange opinions and information on the blog website. BISJHINTUS does not filter, edit, publish or review comments. Comments do not reflect the views and opinions of M/s BISJHINTUS PRIVATE LIMITED, its team, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, M/s BISJHINTUS PRIVATE LIMITED shall not be liable for the Comments or for any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or comments on this website. All comments shall be strictly professional, polite, and respectful and anything otherwise shall have serious consequences.M/s BISJHINTUS PRIVATE LIMITED reserves the right to monitor all Comments and to remove any comments which can be considered inappropriate, offensive, or cause breach of these Terms and Conditions. Neither the Company nor any of its directors, employees, or agents warrant that the Course and/or Website will be uninterrupted or error-free, or give any warranty as to the results to be obtained from the use of the Course and/or Website; In no event will the Company or its directors, employees, or agents be liable to you for any damage, (including, but without limitation, special, incidental, or consequential damage) arising from the use of, or inability to use (for whatever reason), the Course and/Website, including but not limited to damages resulting from loss of data or loss of profits.

12.       INDEMNIFICATION

You agree to indemnify, defend, and hold harmless  M/s BISJHINTUS PRIVATE LIMITED from any and all claims, liabilities, expenses, and damages, including reasonable attorneys' fees and costs, made by any third party related to; 

(a) your use or attempted use of the Blog Website in violation of this Agreement;

(b) your violation of any law or rights of any third party.

13.       TERMINATION

You agree that BISJHINTUS BLOG PORTAL , in its sole discretion, may terminate your use of the Website or your participation in it, for any reason or no reason, upon notice to you. BISJHINTUS reserves the right at any time in their sole discretion to cancel, delay, reschedule or alter the format of any service offered through our blog Website, or to cease providing any part or all of the blog content or related services on our blog website, and you agree that the Company will have no liability to you for such an action. If you no longer desire to access the Course and/or the blog Website, you may terminate your participation at any time. The rights granted to you hereunder will terminate upon any termination of your right to use the Blog Website, but the other provisions of the Agreements will survive any such termination.

14.       ENTIRE AGREEMENT AND SEVERABILITY 

This Agreement is the entire agreement between you and BISJHINTUS BLOG PORTAL relating to blog and supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the blog or any other subject matter covered by these Terms & Conditions. If any provision of these Terms & Conditions is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect.

15.       ADVERTISEMENT

15.1  ASSIGNMENT

15.1.1 BISJHINTUS may at its sole discretion accept contracts from authorised third parties in writing for posting advertisements of such third parties on BISJHINTUS BLOG portal;

15.1.2 BISJHINTUS may post advertisements of third parties on its blog portal. During the term of this agreement, we shall not be responsible for posting or publishing any advertising with respect to such product(s) or service(s) as per clause no. 15.2. BISJHINTUS does not insist any user to buy or avail of any such products or services of any third party instead we only make the user acquainted with the available services and products.

15.2 NATURE OF SERVICES: All the advertisements published or posted on BISJHINTUS BLOG PORTAL by any third party shall strictly be related to health and educational services only.

15.3 SETTLEMENT OF DISPUTES: Any disputes arising out of advertisements posted on  BISJHINTUS BLOG PORTAL shall be governed by the laws of Mangalore. It should be strictly noted that BISJHINTUS does not own any responsibility of the advertisement and hence the respective third party shall be held liable for any legal action.

16.       WAIVER CLAUSE 

Except as provided herein, the failure to exercise a right or to require the performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
